Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Pinio application. Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms.
1. Interpretation and Definitions
- Application: The software program provided by the Company, downloaded by You on any electronic device, named Pinio.
- Company (referred to as "We", "Us", or "Our"): Pinio App - Adrian Gruber, c/o Online-Impressum.de #4751, Europaring 90, 53757 Sankt Augustin, Germany.
- Content: All information, data, text, URLs, or other materials you submit, post, or save to the Service, including what we define as "Pins" and "Discoveries" within the app.
- Country: Germany.
- Device: Any device that can access the Service, such as a mobile phone or tablet.
- In-App Purchase: Refers to the purchase of a product, item, service, or subscription made through the Application and subject to these Terms and/or the terms of the Application Store.
- Service: The Pinio Application and all related services provided by the Company.
- Terms: These Terms of Service that form the entire agreement between You and the Company regarding the use of the Service.
- You: The individual accessing or using the Service.
2. Acknowledgment
By creating an account, downloading, or using the Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, then you may not access the Service.
Your use of the Service is also conditioned on your acceptance of and compliance with our Privacy Policy, which describes how we collect and use your personal information. Please read our Privacy Policy carefully before using our Service.
You represent that you are over the age of 16. The Company does not permit those under 16 to use the Service.
If you are using the Service on behalf of an organization or business, you represent that you have the authority to bind that organization to these Terms.
3. User Accounts
To use Pinio, you must create an account. You agree to:
- Provide accurate and complete information.
- Maintain the security and confidentiality of your password.
- Be solely responsible for all activities that occur under your account.
- Notify us immediately of any unauthorized use of your account.
4. Content and Conduct
- Your Content: You retain full ownership of Your Content. We do not claim any ownership rights to the information you save in Pinio.
- License to Us: By submitting Content to the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, store, process, and display that Content solely for the purpose of operating, providing, and improving the Service for you. This includes processing your "Pins" to generate "Discoveries."
- AI Processing: The "Discoveries" feature uses artificial intelligence to analyze your Content. While we strive for accuracy, we do not guarantee the reliability, completeness, or correctness of any information generated by the AI. You are responsible for verifying the output.
- Prohibited Conduct: You agree not to:
- Use the Service for any unlawful or unauthorized purpose.
- Upload, store, or process Content that is illegal, fraudulent, or harmful.
- Infringe on any third party's copyright, trademark, or other intellectual property rights.
- Upload or transmit viruses, malware, or any harmful code.
- Attempt to gain unauthorized access to our systems or other users' accounts.
- Interfere with or disrupt the normal operation of the Service.
- Use automated scripts, bots, or scrapers without our prior written consent.
- Upload or process Content that you do not have the legal right to use.
5. In-App Purchases and Subscriptions
5.1 Subscription Terms
Certain features of the Service require a paid subscription, available on an automatically renewing basis.
- All billing is handled directly by the App Store. If you purchase a subscription through the Apple App Store or Google Play Store, all payments, billing, and subscription management are processed directly by Apple Inc. or Google LLC in accordance with their respective terms.
- We do not have access to, or control over, App Store billing systems or your payment information. All payment processing is handled exclusively by Apple or Google.
- Payment will be charged to your Apple ID or Google Play account at confirmation of purchase.
- Your subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current billing period.
- Your account will be charged for renewal within 24 hours before the end of the current period.
- You can manage or cancel your subscription at any time in your Apple ID account settings (iOS) or Google Play account settings (Android).
5.2 Free Trials
If a free trial is offered, it will automatically convert to a paid subscription unless cancelled before the end of the trial period. Only new users are eligible for free trials unless stated otherwise. To avoid being charged, you must cancel your subscription at least 24 hours before the end of the trial period.
5.3 Price Changes
We may change the price of subscriptions at any time. If a price change affects your existing subscription, we will provide at least 30 days' notice before the new price takes effect. You will have the option to accept the new price or cancel your subscription before renewal.
5.4 Refunds
All refund requests for subscriptions purchased through the App Store are handled by Apple or Google, not by us.
- For Apple App Store purchases: To request a refund, please visit https://reportaproblem.apple.com or contact Apple Support.
- For Google Play Store purchases: To request a refund, please visit https://support.google.com/googleplay or contact Google Play Support.
We cannot process refunds or manage billing disputes for transactions made through the App Store or Play Store. All refund decisions are made solely by Apple or Google in accordance with their refund policies.
5.5 Right of Withdrawal
As subscriptions are purchased through and managed by Apple or Google, any statutory right of withdrawal for in-app purchases is governed by their respective terms and applicable law. For purchases through the Apple App Store, please contact Apple. For Google Play purchases, please contact Google.
6. Intellectual Property
The Service and its original content (excluding Content provided by You), features, and functionality are and will remain the exclusive property of Adrian Gruber. Our trademarks and branding may not be used in connection with any product or service without our prior written consent.
7. Termination
We may terminate or suspend your account if you breach these Terms. Where possible, we will provide you with reasonable notice and an opportunity to remedy the breach before termination. Upon termination, your right to use the Service will cease immediately. You may also terminate your account at any time through the app's settings. Upon termination by either party, we will delete your account and all associated Content in accordance with our Privacy Policy.
8. Limitation of Warranty
We provide the Service with reasonable care and skill, and we continuously work to improve it. However, to the extent permitted by applicable law, we make no additional warranties beyond those required by law regarding the availability, accuracy, or reliability of the Service.
Nothing in these Terms excludes or limits any warranty that cannot be excluded or limited under applicable law. In particular, nothing in these Terms affects your statutory rights as a consumer under German or European Union law.
9. Limitation of Liability
To the extent permitted by applicable law, the Company's total liability under these Terms shall be limited to the amount actually paid by You through the Service in the 12 months preceding the event giving rise to the claim, or 100 EUR, whichever is greater.
This limitation does not apply to:
- Liability for death or personal injury caused by our negligence.
- Liability for intentional misconduct (Vorsatz) or gross negligence (grobe Fahrlässigkeit).
- Liability for breach of essential contractual obligations (Kardinalpflichten), where liability shall be limited to the foreseeable, typically occurring damages.
- Any other liability that cannot be excluded or limited under applicable law, including liability under the German Product Liability Act (Produkthaftungsgesetz).
10. Governing Law and Dispute Resolution
These Terms shall be governed by the laws of Germany, excluding its conflicts of law rules. If you have a dispute, you agree to first contact us at hello@pinio-app.com to try and resolve it informally.
For users in the European Union, you may also use the European Commission's online dispute resolution platform, which you can access here: http://ec.europa.eu/odr.
In accordance with § 36 of the German Consumer Dispute Resolution Act (VSBG), we inform you that we are not obligated to participate and currently do not participate in dispute resolution proceedings before a consumer arbitration board.
11. Changes to These Terms
We reserve the right to modify these Terms at any time. If a change is material, we will make reasonable efforts to provide at least 30 days' notice before the new terms take effect. By continuing to use the Service after those revisions become effective, you agree to be bound by the revised terms.
